    The essentials in one minute

    Dénichéo connects neighbours who want to sell, buy, give away or swap locally. These terms of use set out the rules that apply to everyone: opening an account, what may and may not be published, how to report abuse, how we moderate, and the limits of our liability. They apply as soon as you browse the site, and in full as soon as you create an account. Each article opens with a plain-language summary, which has no contractual value but lets you grasp the essentials without reading everything.

    • Posting a listing is free within the displayed quota, and Dénichéo charges no commission on transactions between members.
    • We connect people, we do not sell: the sale or gift contract is formed directly between you and the other member.
    • You are the author of what you publish and responsible for it: accuracy of the listing, rights in the photographs, lawfulness of the item offered.
    • Every moderation decision is notified with reasons, and can be challenged free of charge for six months.
    • You can close your account at any time, free of charge and without giving reasons, from your security settings.

    Article 1

    Purpose and scope

    In plain wordsThese rules apply to anyone using Dénichéo, with or without an account.

    These terms of use define the conditions of access to and use of the Dénichéo platform, published by WB CONSULTING (William BASTARD, sole trader), and the mutual rights and obligations of the publisher and its users.

    Dénichéo is an online intermediation service allowing its members to post, browse, search and exchange classified ads for sale, gift or swap, at city, department or regional level, and to contact one another through an internal messaging system.

    They apply to every visitor, whether or not they hold an account. Browsing public pages entails acceptance of the rules that concern it; creating an account entails acceptance of these terms in full.

    Article 2

    Definitions

    In plain wordsA few words come up often: here is exactly what they mean.

    In all of Dénichéo's contractual documents, the following terms have the meaning set out below, whether used in the singular or the plural.

    • “Platform” or “Service”: the denicheo.com website, its subdomains, interfaces and all the features they make available.
    • “Publisher” or “Dénichéo”: WB CONSULTING, the sole trader business operated by William BASTARD.
    • “Visitor”: any person browsing the Platform without being logged in.
    • “Member” or “User”: any natural person holding an account, whether personal or professional.
    • “Personal member”: a member acting for purposes outside any commercial, industrial, craft, professional or agricultural activity.
    • “Professional member”: a member acting for purposes relating to their business activity, including through another person acting in their name or on their behalf.
    • “Listing”: any offer to sell, give or swap published by a Member, including a title, description, photographs, a price where applicable and a location.
    • “Content”: any item published or transmitted by a Member: listing, photograph, message, review, report or profile element.
    • “Paid option”: any paid service supplied by Dénichéo to a Member (promotion, cross-posting, professional plan, advertising space, website link).
    • “Virtual credit”: an internal, non-monetary unit of account usable solely to pay all or part of a Paid option.
    Article 3

    Contractual documents and order of precedence

    In plain wordsSeveral documents govern Dénichéo. Where they conflict, the more specific one prevails.

    The relationship between the User and Dénichéo is governed by a set of documents forming an indivisible whole, permanently accessible from the site footer.

    In the event of conflict, they prevail in the following descending order, the more specific provision prevailing over the general one.

    • 1. Any special conditions accepted when subscribing to a specific Paid option.
    • 2. The professional terms of service, for Professional members.
    • 3. The terms of sale, for consumer Members purchasing a Paid option.
    • 4. The promotional game rules, for participation in games run on the Platform.
    • 5. These terms of use.
    • 6. The privacy and cookie policy.
    Good to knowWhere the User is a consumer within the meaning of French consumer law, the protective provisions of that law apply automatically and prevail over any conflicting clause in any of these documents.
    Article 4

    Acceptance and changes to these terms

    In plain wordsCreating an account means accepting these terms. Any significant change is announced before it takes effect.

    Creating an account entails full acceptance of these terms, evidenced by submitting the registration form, which contains an explicit reference to this document and to the privacy policy.

    Dénichéo may amend these terms to reflect changes in the Service, its offering, its features or the applicable legal framework.

    Any substantial change is notified to Members through a message displayed on the Platform and, where relevant, by email, at least fifteen (15) days before it takes effect. That period is extended to thirty (30) days for Professional members, in accordance with Article 3 of Regulation (EU) 2019/1150.

    A Member who does not accept the new terms may close their account free of charge before they take effect. Continued use of the Service after that date constitutes acceptance.

    The version applicable to a dispute is the one in force at the time of the relevant facts. The online version prevails; each version bears a number and an update date.

    Article 5

    Access conditions and account creation

    In plain wordsYou must be an adult, provide accurate details and hold a single account.

    Browsing the public pages of the Platform is free and requires no account. Posting a Listing, using the messaging system, managing favourites, taking part in games and purchasing a Paid option all require an account.

    Accounts may only be opened by natural persons of full age with legal capacity to contract under French law. The Service is not intended for minors, who must not create an account.

    Registration requires accurate, truthful, complete and up-to-date information: surname, first name, public nickname, valid email address, telephone number and password. The email address must be verified before certain features become available.

    A Professional member must additionally declare that status and provide their company identification details, as described in the professional terms of service.

    Each person may hold only one account. Creating multiple accounts, accounts under a false identity, or accounts intended to circumvent a sanction is prohibited.

    Worth notingDeclaring a false identity or impersonating a third party to open an account may constitute a criminal offence under French law, independently of the contractual sanctions provided for here.
    Article 6

    Account security and credentials

    In plain wordsYour credentials are personal. Enable two-factor authentication and tell us immediately if your account is compromised.

    Login credentials are strictly personal and confidential. The Member is solely responsible for keeping them safe and for any operation carried out from their account.

    Dénichéo provides enhanced security mechanisms: two-factor authentication, passkeys, active session monitoring and login alerts. Enabling them is strongly recommended.

    The Member undertakes to inform Dénichéo without delay, through the support desk, of any unauthorised use of their account, any loss of credentials or any breach of their confidentiality, so that protective measures may be taken.

    Dénichéo never asks for a Member's password, whether by email, telephone or internal messaging.

    Article 7

    Posting listings

    In plain wordsA listing must be accurate, complete, correctly categorised and illustrated with your own photographs.

    The Member is the sole author of, and solely responsible for, the Listings they publish. They warrant the accuracy and sincerity of the information contained in them: description of the item or service, actual condition, price, quantity available, location and handover arrangements.

    Listings must be posted in the category and subcategory that genuinely match the item or service offered, and be written in French, in comprehensible language.

    Photographs must depict the item actually offered. The Member warrants that they hold all necessary rights in the images published and that these do not infringe copyright, trade mark rights, image rights or privacy.

    The same offer may not be the subject of several simultaneous Listings, including in different categories or localities. Repeatedly reposting an identical Listing solely to move up the results is treated as circumvention.

    The number of Listings that may be published over a given period is subject to a quota, shown on the “Tarifs” page and recalled at the time of publication.

    • The price displayed must be the price actually requested, in euros, inclusive of all taxes for a professional seller.
    • The location entered must correspond to the actual handover location, so as not to distort other Members' proximity searches.
    • Personal contact details (telephone, email, external links) should not appear in the text or photographs of a Listing: the internal messaging system exists for that purpose.
    • Adding a link to an external website on a profile or Listing is reserved for eligible Professional members and subject to prior approval, as set out in the professional terms of service.
    Article 8

    Prohibited content, goods and services

    In plain wordsAnything whose sale is prohibited or regulated by law is prohibited on Dénichéo, as is hateful or misleading content.

    It is prohibited to publish, offer for sale, make available or solicit any goods, services or content whose transfer, possession, distribution or promotion is prohibited or regulated by French or European Union law.

    This prohibition applies regardless of wording and regardless of the channel used: title, description, photographs, characteristics, internal messaging or profile elements.

    • Weapons, ammunition, weapon parts, explosives and their regulated replicas.
    • Narcotics, psychotropic substances, doping products, chemical precursors and related paraphernalia.
    • Medicines, prescription medical devices, non-compliant food supplements and health products subject to a pharmacy monopoly.
    • Counterfeit goods, unauthorised copies, and items infringing a trade mark, design, patent or copyright.
    • Stolen or unlawfully obtained goods, or goods whose origin cannot be justified.
    • Protected animal and plant species, ivory, regulated hunting trophies, and the transfer of live animals in breach of French animal welfare rules.
    • Pornographic content, prostitution-related offers, child sexual abuse material, or sexual services.
    • Hateful, insulting, defamatory, discriminatory or negationist content, content glorifying terrorism or inciting violence.
    • Tobacco, vaping products, alcohol sold in breach of applicable rules, and food products not meeting hygiene and traceability requirements.
    • Identity documents, licences, diplomas, number plates, means of payment, personal data or contact files.
    • Financial services, credit offers, investments, crypto-assets, gambling and pyramid schemes.
    • Vehicles that do not meet the legal requirements for sale (registration certificate, valid roadworthiness test, administrative status certificate).
    • Software, accounts, subscriptions, activation keys, decoders or devices enabling unauthorised access to protected services or content.
    • Any misleading or fictitious Listing, or any Listing published to harvest data, phish, canvass, advertise covertly, or otherwise divert the Platform from its purpose as a local classified ads service.
    Worth notingThis list is not exhaustive. Dénichéo may remove any Content which, although not expressly listed above, breaches the law, infringes third-party rights or compromises Member safety.
    Article 9

    Specific obligations of sellers

    In plain wordsA private seller who sells a lot may be reclassified as a professional, with the obligations that entails.

    A Member offering goods or services remains solely responsible for complying with their legal, tax and social security obligations, including declaring any income generated.

    In accordance with French tax law, Dénichéo informs its Members, in connection with each transaction it invoices, of the tax and social security obligations incumbent on them, and provides links to the relevant official websites.

    A Member who sells habitually, in volume, for profit, or who buys in order to resell, may be classified as a professional under consumer law, irrespective of the type of account they opened.

    A Professional member must declare that status, state their company name and identification number, and comply with all their obligations towards consumers: pre-contractual information, legal warranty of conformity, warranty against hidden defects and, in distance selling, the right of withdrawal.

    Dénichéo may require any Member displaying the characteristics of a business activity to switch to a professional account, and may suspend their publications failing regularisation.

    Good to knowPresenting oneself as a private individual while acting as a trader constitutes a misleading commercial practice under French consumer law.
    Article 10

    Rights in published content

    In plain wordsYour photographs and texts remain yours. You only allow us to display and promote them while the listing is online.

    The Member retains all intellectual property rights in the Content they publish.

    By publishing Content, the Member grants Dénichéo a non-exclusive, royalty-free, worldwide licence limited to the period of publication, plus the technical time needed to remove it from caches and backups.

    That licence is strictly limited to the rights needed to operate the Service: hosting, storage, reproduction, adaptation to display formats and resolutions, possible automatic translation, indexing by search engines, and promotion of the Listing on the Platform, in its newsletters and on its social media accounts.

    Cross-posting a Listing to a third-party social network never happens automatically: it requires an express request from the Member, evidenced by purchasing the relevant option and confirming a review screen.

    The licence terminates automatically when the Listing is withdrawn or the account is closed, without affecting reproductions already made in good faith by third parties, in particular in search engine caches.

    Article 11

    Relations between members and Dénichéo's role

    In plain wordsDénichéo is not a party to the transaction: the contract is formed directly between seller and buyer.

    Dénichéo provides a technical intermediation service. It is neither seller, buyer, donor, agent, broker nor escrow, and takes no part in the conclusion or performance of contracts between Members.

    The sale, gift or swap contract is formed directly between the Members concerned. Payment of the price and handover of the item take place between them, off-platform, with no financial involvement from Dénichéo, which charges no commission on such transactions.

    Dénichéo does not guarantee the existence, quality, conformity, safety or lawfulness of the goods and services offered, nor the solvency, actual identity or good faith of Members.

    Identity checks, trust indicators and badges displayed on the Platform are decision aids, not guarantees.

    Any dispute arising from a transaction between Members must be settled between them. Dénichéo may nevertheless, upon report, take moderation measures regarding the Content or account concerned, and disclose the required information to the competent authorities upon lawful request.

    • Prefer handover in person, in a public and busy place, and inspect the item before paying.
    • Refuse any untraceable or irrevocable payment method requested off-platform, and any request for full bank details.
    • Beware of unusually attractive offers, hurried buyers, improvised couriers and payment links sent by message.
    • Immediately report any attempted fraud from the listing, profile or conversation concerned.
    Article 12

    Internal messaging and rules of conduct

    In plain wordsMessaging is for discussing a listing, not for canvassing or harassment. It may be scanned to detect scams.

    The internal messaging system allows Members to discuss a Listing. Its use is strictly limited to that purpose.

    The following are prohibited: unsolicited commercial canvassing, bulk messaging, distribution of fraudulent links, insulting, threatening, discriminatory or unsolicited sexual content, harassment, and requests for bank details.

    Automated detection mechanisms may analyse messages to identify known fraud patterns, manifestly unlawful content and attempts to circumvent the Service. They do not involve systematic human reading, except following a report or an alert.

    A Member may block another Member and report a conversation at any time. Conversations are kept for a limited period, as specified in the privacy policy.

    Article 13

    Gifts and free items

    In plain wordsGifts are free by definition: asking for anything in return, even symbolic, is prohibited.

    Dénichéo provides a dedicated area for gifts and free items, to encourage local reuse and reduce waste.

    A Listing posted in the “Gift” category implies handing over the item free of charge: no financial consideration, no handling fee, no reservation fee and no linked purchase obligation may be required from the recipient. Only actual shipping costs are permitted, and only if announced at the time of publication.

    The donor warrants that the item is lawful, complete, usable or repairable, and free from danger. Items presenting a safety risk or subject to a regulated take-back obligation may not be given away through the Platform.

    Immediately and systematically reselling items obtained free of charge on the Platform for profit constitutes a misuse of the Service and may lead to a moderation measure.

    Article 14

    Chatbot and automated features

    In plain wordsThe assistant is a help tool, not legal advice: its answers may be inaccurate and do not bind Dénichéo.

    The Platform provides a chatbot based on a language model, together with various automated features: category suggestion, image search, indicative price estimates, duplicate detection and result ranking.

    The assistant is a navigation and search aid. Its answers are generated automatically, may contain inaccuracies or omissions, and never constitute personalised legal, tax, technical or commercial advice.

    Exchanges with the assistant are processed by a technical provider established in the European Union and retained for a limited period, as described in the privacy policy. Sensitive data and bank details should not be entered.

    No decision producing legal effects for a Member, in particular regarding moderation or account suspension, is taken solely on the basis of automated processing without the possibility of human intervention.

    The main ranking parameters for Listings, and their relative importance, are described in the professional terms of service and on the corresponding help page.

    Article 15

    Reporting unlawful content

    In plain wordsA reporting button appears on every listing, profile and message. You are told the decision and its reasons.

    Pursuant to Article 16 of Regulation (EU) 2022/2065, any Visitor or Member may report Content they consider unlawful or contrary to these terms, using the reporting mechanism available from the Listing, profile or conversation concerned, or in writing to the publisher's contact address.

    A report is best served by stating the exact address of the Content, the reasons why it is considered unlawful, and an email address for the reply. Acknowledgement of receipt is sent without delay where those details are known.

    Reports are handled in a timely, non-arbitrary and objective manner. Reports from trusted flaggers within the meaning of Article 22 of that Regulation are given priority.

    Content likely to constitute a criminal offence involving a threat to life or personal safety is reported immediately to the competent authorities.

    Article 16

    Moderation, decisions and redress

    In plain wordsAny measure against your content or account is explained, and you can challenge it free of charge.

    Following a report, an internal check or an order from an authority, Dénichéo may remove Content, restrict its visibility, demote it, suspend a Listing, restrict access to certain features, or suspend or terminate an account.

    Any measure taken regarding Content or an account is accompanied by a statement of reasons sent to the Member concerned, in accordance with Article 17 of Regulation (EU) 2022/2065. It specifies the measure, its scope and effects, the facts and circumstances relied on, the contractual or legal basis, any use of automated means, and the available redress options.

    The Member has six (6) months from notification to challenge the decision, free of charge, using the complaint form available in their account area. The complaint is reviewed by a natural person, distinct from the original decision-maker where the organisation allows, within a reasonable time.

    Where the complaint is well-founded, the decision is reversed without delay and the Content or account restored. Otherwise, a reasoned reply is sent to the Member, who may still refer the matter to a certified out-of-court dispute settlement body under Article 21 of that Regulation, or to a court.

    In cases of serious breach, established fraud, threats to Member safety or an order from an authority, the measure may be applied without prior notice, the statement of reasons then being sent afterwards.

    • Removal or hiding of the Content concerned.
    • Demotion, reduced visibility or removal from promotional placements.
    • Warning sent to the Member.
    • Temporary suspension of publishing, messaging or the account.
    • Account termination and ban on re-registration, in cases of serious or repeated breach.
    Article 17

    Prohibited uses of the platform

    In plain wordsScraping listings, bypassing security or automating use of the site without authorisation is prohibited.

    Any use of the Service contrary to its purpose, and any behaviour liable to compromise its operation, security or integrity, is prohibited.

    • Automated extraction, scraping, unauthorised indexing or reconstruction of all or part of the Platform's databases.
    • Use of bots, scripts or any automated device to publish, browse or contact in bulk, outside the interfaces provided for that purpose.
    • Circumventing quotas, security measures, access restrictions or sanctions.
    • Introducing malicious code, unauthorised vulnerability testing, load testing and any action liable to saturate the Service.
    • Impersonating another Member, the publisher or a partner, including in a nickname, logo or signature.
    • Reselling, renting, sharing or otherwise commercialising access to an account or to the Service.
    Good to knowFraudulently accessing or remaining within an automated data processing system, and impeding its operation, are criminal offences under French law.
    Article 18

    Paid options

    In plain wordsPublishing remains free. Promotions and professional plans are optional and governed by dedicated terms.

    Publishing Listings is free within the quota applicable to the account. Dénichéo additionally offers optional Paid options: promotions, availability countdown, cross-posting to social networks, extra photographs, periodic bumps, professional plans, local advertising space and website links.

    Details of these services, their essential characteristics and current prices appear on the “Tarifs” page of the Platform, which forms an integral part of the contractual documents.

    Ordering, payment, withdrawal, invoicing and warranty terms applicable to consumer Members are set out in the terms of sale. Those applicable to Professional members are set out in the professional terms of service.

    No Paid option is renewed or charged without an express order from the Member. Automatically renewing professional subscriptions are identified as such before purchase and may be cancelled as provided in the professional terms of service.

    Article 19

    Virtual credit and referral programme

    In plain wordsVirtual credit is not money: it only pays for options on Dénichéo and is never refundable.

    Dénichéo may grant certain accounts internal virtual credit, in particular upon reaching a given number of published Listings, through a validated referral programme, through a promotional game or as a goodwill gesture.

    Virtual credit is neither a means of payment, nor electronic money, nor a debt instrument. It cannot be withdrawn, converted into cash, assigned, transferred to another account or used outside the Platform.

    It may only be used to pay all or part of the price of a Paid option, within the limits set by Dénichéo. Its use is stated on the corresponding invoice.

    The conditions for granting virtual credit (amounts, thresholds, caps, validity) may be changed for the future, without retroactive effect on credit already acquired. Credit acquired is lost when the account is closed, for whatever reason.

    Referral requires the referred person to create a separate account, with an identity and household distinct from the referrer's. Self-referral, fictitious accounts and any scheme to obtain credit improperly result in cancellation of the credit concerned and may justify account suspension.

    Article 20

    Availability, changes and interruptions

    In plain wordsThe service may change or be interrupted for maintenance: we give notice where possible.

    Dénichéo undertakes to use reasonable efforts to ensure the availability and continuity of the Service, without assuming an obligation of result in that respect.

    Access may be temporarily suspended for maintenance, updates, security work or technical developments. Where a planned interruption is significant, prior notice is published on the Platform.

    Dénichéo may change the features of the Service, add to them, modify them or remove them. Removal of a material feature is announced as provided in the article on changes to these terms.

    The Member remains responsible for their equipment, internet access and terminal security, and for the related costs.

    Article 21

    Liability

    In plain wordsWe answer for our own breaches, not for what members do to one another.

    Dénichéo is liable for direct damage resulting from a breach of its own contractual obligations, under general law.

    It cannot, however, be held liable for Content published by Members, for transactions concluded between them, for the non-performance or defective performance of such transactions, for a Member's conduct, or for damage resulting from a Member's breach of their own obligations.

    Nor can it be held liable in cases of force majeure, acts of third parties, failure of electronic communications networks, or the Member's own fault, in particular disclosure of their credentials.

    Nothing in these terms limits or excludes Dénichéo's liability in cases of wilful misconduct, gross negligence, personal injury, or where the law prohibits such limitation. As regards Professional members, Dénichéo's liability is capped as provided in the professional terms of service.

    Article 22

    Personal data

    Personal data processing carried out in connection with use of the Service is described in the privacy and cookie policy, which forms an integral part of these terms.

    Each Member has the rights of access, rectification, erasure, restriction, objection and portability provided for by Regulation (EU) 2016/679, exercisable from their account area or through the support desk.

    A Member who obtains another Member's personal data in connection with a transaction (name, address, contact details) may only use it for that transaction, to the exclusion of any marketing or transfer to a third party.

    Article 23

    Term, termination and account closure

    In plain wordsYou may leave at any time, free of charge. We may only terminate on legitimate grounds, with notice except in urgent cases.

    The account is opened for an indefinite term. The Member may close it at any time, free of charge and without giving reasons, from the “Security” section of their account area or through the support desk.

    Closure results in the withdrawal of active Listings and the end of access to Member-only features. It does not affect obligations already incurred, in particular payment for Paid options already ordered and commitments made to other Members.

    Dénichéo may terminate a Member's account in cases of serious or repeated breach of these terms, fraud, threats to Member safety, unlawful use of the Service, or continuous account inactivity for more than three (3) years.

    Except in cases of urgency, serious breach, fraud or an order from an authority, termination is preceded by a warning and a reasonable period allowing the Member to remedy the situation. Professional members benefit from the thirty (30) days' notice provided in the professional terms of service.

    Data is retained or deleted after closure under the conditions and periods set out in the privacy policy.

    Article 24

    Miscellaneous provisions

    In plain wordsEvidence, assignment, waiver and severability: the technical rules of the contract.

    The computerised records kept in Dénichéo's systems, under reasonable security conditions, are deemed to constitute evidence of communications, orders and payments between the parties.

    Dénichéo's failure at any time to rely on a provision of these terms does not constitute a waiver of its right to rely on it later.

    If any provision is held void or unenforceable, the remaining provisions remain in full force, and the provision concerned is replaced by a valid provision of equivalent economic effect.

    Dénichéo may assign these terms and the resulting rights and obligations to a third party, in particular as part of a business transfer or restructuring, without reducing the Member's rights. The Member may not assign their account or the rights they derive from these terms.

    These terms are drafted in French. Any translation is provided for information; in the event of discrepancy, the French version prevails.

    Article 25

    Governing law and dispute resolution

    In plain wordsFrench law. First an amicable solution, then mediation, then the courts.

    These terms are governed by French law, without prejudice to more protective mandatory provisions of the consumer's country of habitual residence.

    Any complaint must first be sent to Dénichéo's support desk, from the account area or to [email protected], in order to seek an amicable solution.

    A consumer Member may then refer the matter free of charge to a consumer mediator, as described in the terms of sale. Professional members have access to the mediation arrangements set out in the professional terms of service.

    Failing amicable resolution, the French courts have jurisdiction. A consumer may bring proceedings, at their choice, before the court of the place where they resided when the contract was concluded or where the harmful event occurred, or before the court of the defendant's domicile.
